9 MEDIATIONANDARBITRATION Thiscourseexaminesfederalandstatelawregarding arbitrationandmediationandcomparesthese systemsofdisputeresolutiontolitigation. INTERVIEWING, COUNSELING, ANDNEGOTIATING Throughavarietyofsmall- groupandlarge- group exercises, studentsassumetheroleoflawyertolearn theartandskillofinterviewing, counseling, and negotiating; toplanforanddevelopacasefromone stagetoanother; toanticipateanddealwithethical issues; andtodeveloptheskillofself- critique. INTERNATIONALCOMMERCIALARBITRATION SEMINAR Thisseminarexaminesthepracticalapplicationof alternativedisputeresolutiontechniquesusedin internationaltrade. Whileprimaryfocusison arbitration, othertechniques, suchasmediation ( includestudentsimulations), areincluded. LABORARBITRATION Thiscoursedealswiththelawandpracticeoflabor arbitrationinthepublicandprivatesectors. Included isastudyofthegrievancearbitrationprocess pursuanttocollectivebargainingagreements, aswell asarbitrationofissuesinreachinganewagreement. COLLABORATIVELAW Thiscourseexposesstudentstothecollaborative modelofpracticinginthefamilylawsetting, inwhich attorneysforbothpartiestoadisputeagreetoassist theirclientsinproblemsolving, resolvingconflicts, andreachingagreementsusingcooperativestrategies ratherthanadversarialtechniquesandlitigation. COLLECTIVEBARGAINING Thiscourseexaminesthedevelopmentoflaborlaw fromthecollectivebargainingperspectiveinorderto provideasettingfortheanalysisofcontemporary collectivebargaining/ laborlawproblems. Thecourse concentratesonthedevelopmentoftradeunionsand employers'associations, togetherwithlegalprovisions fortheresolutionofconflictbetweentheparties. INVESTORRIGHTSCLINIC Underfacultysupervision, studentattorneys representinvestorsofmodestmeanswhohave arbitrabledisputeswiththeirsecuritiesbrokers. Studentsworkoncriticallawyeringskillsincluding clientinterviewingandcounseling, factinvestigation, claimevaluation, participatingindiscovery, legal research, preparationoflegalmemoranda, conductinganarbitrationormediationbeforeFINRA DisputeResolution, andnegotiatingasettlement. ENVIRONMENTALLAWSEMINAR: ENVIRONMENTAL DISPUTERESOLUTION( THEORY) Thecourseisdesignedtoexplorethecommon characteristicsofenvironmentaldisputesandthe rangeofresolutionoptionsfromrights- based approaches, suchaslitigationandappellate advocacy, tointerest- basedapproaches, suchas consensusbuilding, mediation, andfacilitation.
